Introduction

Welcome to Hair Now®. This Privacy Policy explains TTEM, LLC’s and their affiliated entities’ (“Hair Now” “we”, “us” or “our”) practices for collecting, using, maintaining, protecting, and (under limited circumstances) disclosing or sharing information we collect from you. Hair Now does not sell nor lease your information.

This Privacy Policy applies to information we collect from you, directly or indirectly, on or through Hairforyou.com, and from any advertising content, communication, functionality, third party or social media platform, interactive feature, tool, or application (the "Platforms"). This Privacy Policy also applies to information we collect from you in person (in center, over the phone, via text message, chat, in teleconference, or at Hair Now events).  This Privacy Policy does not apply to nor protect information that you share with third-party sites or applications, nor to information that third-party sites or applications collect from you to find out what those practices are, you must reach out to the third party directly.

We will deem your continued use of the Platforms and or our services, and or your failure to notify us that you object to any of the terms contained in this Privacy Policy (as it may be updated from time to time) your agreement to be bound by these terms.

If you do not want your information to be treated as described in this Privacy Policy or in the Terms of Use, if you disagree with our information collection, usage, storage, safeguarding or disclosure practices or if you are unable to contract with us (because you are younger than 18 or other reasons), you should not access or use the Platforms nor avail yourself of our services.

Children’s Privacy

Our Platforms are intended for use by adults 18 years of age or older and are therefore not directed to anyone younger than 18 (“Minors”). We do not knowingly collect, nor use, and therefore do not disclose, information from Minors. Children younger than 13 should always get permission from their parents before sending personal information (such as name, email or physical addresses, and phone numbers) over the Internet. If we learn we have collected or received Personal Information from a child under 13 without parental consent, we will delete that information. If you believe or know that we have any information from or about a child under 13, please contact us as provided in the Contact Us section below. If you are under 18 years old, you should not use, register, nor provide any information on our Platforms (including your name, screen name, user name, address, telephone number, email address) and you should refrain from using the Platforms’ features.

HIPPA

Hair Now is not a medical provider, and as such Hair Now is not bound by those regulations which apply to an individuals’ medical records and other personal health information under the Health Insurance Portability and Accountability Act, commonly known as HIPPA. However, Hair Now is committed to ensuring that the information it collects from you is only used in accordance with the terms of this Privacy Policy.

California Residents

In addition to the information contained in this Privacy Policy, pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request certain information from a business with whom the California resident has an established business relationship to find out the types of personal information the business shares with third parties for those third parties' direct marketing purposes and the identities of the third parties with whom the business has shared such information during the immediately preceding calendar year. To exercise your California rights, you may make one request each year by emailing us at support@myhairnow.com and mentioning in your letter that you are making a California Shine the Light inquiry. Your request will be processed within one month.

What Information Do We Collect and How Is it Collected?

We collect several types of Information (as defined below) from and about our customers, prospective customers, and the users of our Platforms.  

We collect some information overtly by explicitly asking that you share such information with us; other information is collected automatically as you navigate through our Platforms, and some information about you is obtained from third parties (such as social media sites or apps) who have collected your information, or with whom you have previously shared your information pursuant to their privacy policies.

The information we collect overtly or explicitly includes but is not limited to information which personally identifies you, for instance, name, postal address, e-mail address, telephone number, credit card, or payment information ("Personal Information"). We only collect Personal Information when you provide it to us, whether in person, over the phone, via chat, teleconference, email, or through any other interaction you may have with our Platforms (when you fill out a form, participate in a sweepstake or any other game or survey, post a comment or review, make a query, or transact with us (make purchases) in our Platforms).

The Information we collect automatically as you navigate through our Platforms is information which on its own would not identify you (non-identifiable information), and it includes but is not limited to your gender, ethnicity, internet connection, “IP” address, browser type, geolocation, online identifier, equipment information (operating system), as well as usage, and behavior details over time (for instance, time and date of visits to the site).  Some of this information is shared by your internet provider, or other third parties, and it is gathered using automatic data collection technology, cookies, flash cookies, web beacons, embedded pixels, local data storage, and other tracking technologies.

Finally, we also collect information from third parties with whom we have a contractual relationship. These third parties may share either non-identifiable information or Personal Information and they do so pursuant to their policies, and the terms under which you may have agreed to have them collect, use, process, protect, store or share your information.  Within any of our Platforms with purchase functionality or Platforms which we may use to assist us with recruiting employees, we would collect Personal Information, non-identifiable information, as well as any other information which is explicitly requested form you. Hair Now is not responsible for the accuracy of the information about you which third parties share with us or how such third parties collect, use, process, protect, store, or share your information, and you should refer to those parties’ privacy policies to find out. 

In this Privacy Policy we refer to your Personal Information, the information we collect automatically as you navigate through our Platforms, the information we gather about you from third parties, and other information we record about you, collectively, as “Information.”

All of the Information we collect from you over time is eventually attached to an individual profile we create to identify you once you provide us with your Personal Information or become a client.

 Why Do We Collect Information and How Do We Use It?

We collect Information about and from you to:

  1. Stay in touch and determine how and when you want to be contacted
  2. Deliver information you requested
  3. Notify you of Hair Now’s latest offers and promotions (marketing and advertising)
  4. Manage our business relationship if you are a client, for instance by sending appointment reminders, invoices, important notices
  5. Tailor our offers to fit your needs
  6. Create and maintain a personal profile about you and recognize when you return to our Platforms
  7. Improve our Platforms, speed up your searches, estimate our audience size and usage patterns
  8. Assist our advertising partners to display Hair Now offers as you browse the internet
  9. Fulfill any purpose we may have disclosed or for which you consented, or provided the Information
  10. Comply with any legal requirement

You Have Options

Hair Now’s goal is to communicate with you in the manner you prefer and opting to receive marketing and advertising communications is not a condition for our services.

Again, we do not control third parties' collection or use of your Information. However, these third parties may provide you with ways to manage your information. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

Disclosure of Personal Information

Hair Now will not rent or sell Information, but Hair Now works with a variety of third parties and service providers to help provide you with our product or services and we may share your Information with them to support these efforts. We may share your Information with third parties for Hair Now’s and their affiliates’ marketing purposes, but we do not share your Personal Information with unrelated third parties for their marketing purposes. Additionally, Hair Now shares your Information under the circumstances described in this section.

  1. Social Networking Sites, third party platforms, and software.  When you interact with third party websites or platforms which are unrelated to and not under Hair Now’s control, such as social media or networking sites, analytics services, or an advertising network partner these third parties may require that You or Hair Now share your Information. If you agree to interacting with those third party websites or platforms, such as by clicking on a Hair Now ad on Facebook, or by logging in to your Skype account for a teleconference with a Hair Now employee, it means that you are consenting to our sharing of your Personal Information with those third party websites or platforms, and acknowledge that we will do so. Please note that once we share or post your Personal Information with such company, your Personal Information becomes subject to the third party’s privacy practices and may become public depending on those third party’s practices and your agreement with them. Hair Now will have no way to control what that company does with your Information. Hair Now explicitly disclaims responsibility for or liability for the privacy practices or actions of third parties. Most of these third parties will not change their tracking practices in response to “do-not-track” signals from your web browser and we do not have any contractual safeguards in place that would require them to do so.
  2. Analytics Services, Advertising Networks and or Providers. When you visit our Platforms, we may be sharing your non identifiable information, such as your browsing or usage with third parties, to measure or target ads about products and services. Third parties use cookies, web beacons, pixel tags and similar technologies to collect or receive information about your interaction with us on our Platforms and elsewhere on the internet (“Tracking Data”) and use such Tracking Data to display ads for Hair Now. These advertising networks or providers do not change their tracking practices in response to “do-not-track” signals from your web browser and we do not obligate these parties to honor “do-not-track” signals.   3. Affiliates. Hair Now may share your Information with its affiliates, subsidiaries, or parent companies (“Affiliates”) for different purposes, including but not limited to, to provide services to you, or to allow our Affiliates to provide services to Us, and or to coordinate Hair Now’s business activities and services, and to understand and take advantage of market opportunities.
  4. Service Providers. Hair Now shares your Personal Information on a need to know basis with third-party service providers when it is necessary for those third parties to provide services to you personally, or on Hair Now’s behalf or to Hair Now, these service providers may include but are not limited to marketing companies, credit card companies, mailing services, calling centers, or subcontracting customer service agencies.
  5. Legal and Safety Obligations. Under certain circumstances, Hair Now may be bound to disclose Information if required to do so by law, law enforcement or other government authorities by way of search warrant, subpoena, court order or other legal process, or if Hair Now believes such action is necessary to protect and defend the rights, property or personal safety of Hair Now and its Platforms, visitors to the Hair Now websites, and clients of our services, or generally to prevent, investigate, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Use or any other agreement related to our services.
  6. Business Reasons. Hair Now may disclose Personal Information about you in connection with a merger, bankruptcy, acquisition, dissolution, reorganization.

Security

Hair Now places great importance on the security of any Information collected from its clients and visitors. We have implemented technical and organizational measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, destruction, or disclosure, by encrypting our Platforms, by reviewing and updating our information collection, storage and processing practices periodically, including physical security measures, to guard against unauthorized access to systems. We also restrict access to Personal Information to Hair Now employees, contractors and agents who need to know that information in order to process it for us, and who are subject to contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations. Please note, however, that although at Hair Now we strive to adhere to industry standards of security to protect your Personal Information, Hair Now is unable to guarantee the safety of your Personal Information, including with respect to unauthorized access or use of your data by third parties, and the internet is not fully secure. The measures we use are appropriate for the type of Information we collect. We cannot promise that your use of our Platforms will be completely safe. We encourage you to use caution when using the Internet and our Platforms.

Hair Now’s Mobile Offers Terms and Conditions (Text Messages)

This section explains the terms and conditions that apply when you sign up to receive Hair Now offers on your mobile device via text message (“Mobile Offers”) and is effective as of the Effective Date set forth in this Privacy Policy. Signing up to receive Mobile Offers is not required to receive Hair Now services. You are responsible for periodically checking this Privacy Policy for changes to this section.

To receive Mobile offers you can text JOIN to 91938. When you do, you are consenting to receive recurring messages from Hair Now, on average, up to 5 promotional mobile text alerts or messages per month which will be sent via an automatic telephone dialing system. After you text JOIN you will receive a confirmation message to indicate we have received your request. Hair Now does not charge for sending Mobile Offers, but message and data rates from your mobile carrier likely apply. You must be at least 18 years of age to sign up. When you opt in to receive Email Offers, you are confirming that you are 18 years of age or over, and you are explicitly consenting to receiving up to 5 promotional Email Offers (email alerts or messages) per month sent via an automatic emailing system. By providing your Personal Information to us regardless of the method by which you provide it, including but not limited to, via our Platforms, via a form, via text, over the phone or through social media, you are consenting to receiving Follow Up Calls from time to time for a period not to exceed two years after you first provided us your Personal Information unless you revoke such consent before that time.
